Wrongful Death
Wrongful Death is defined as the death of an individual as a direct result of the negligence of another individual, company, or entity.
Years of Potential Life Lost
Years of potential life lost (YPLL) is a measure of premature mortality. YPLL is presented for persons under 75 years of age because the average life expectancy in the United States is over 75 years.
Mental Anguish
Mental suffering. It is different from a physical injury, but may be considered in awarding damages. In some cases damages for mental anguish can be awarded even if no physical injury occured.
Disc Injury
Injury to the supporting discs (cushions) located between each spinal bone. Discs that are ruptured or cracked may cause extraordinary pressure resulting in back pain.
Occupational Disease
An illness resulting from long-term employment in a particular type of work, such as mesothelioma (a type of cancer) from workers exposed to asbestos.
Gross Negligence
Negligence for the safety or lives of others which is so great it appears to be intentional.
Trauma
Any injury, whether physically or emotionally inflicted. "Trauma" has both a medical and a psychiatric definition. Medically, "trauma" refers to a serious or critical bodily injury, wound, or shock.
Eggshell skull
A hypothetical medical condition used to illustrate the idea that if you are at fault when you injure someone, you are responsible for all the consequences, whether you could have foreseen them or not.
Carbon Monoxide Poisoning
Carbon monoxide is often referred to as CO, which is its chemical symbol. This blocks oxygen from getting into your body, which can damage tissues in your body and can kill you.
Affidavit
A written document which the signer swears to be true. The signer may swear under oath before a notary public ot other authorized official, or may make a declaration under penalty of perjury.
